LEASES



SUB - LEASE 'A'
The Sub-Lease 'A' / License entitles an allottee/ transferee of a residential/commercial plot to obtain leasehold rights, by execution of which an allottee/ transferee will be able to obtain loan from the House Building Finance Corporation or any Bank or Financial institution. This will also entitle him/her to step on the plot and commence construction after the Building plans are approved by the Cantt Board/MEO. This lease has to be executed before start of construction work.: -
DOCUMENTS REQUIRED FOR SUB - LEASE 'A'
In order to get the Sub-Lease registered, the allottees/ transferees/attorneys are required to complete the following formalities:-
a.
Application addressed to the Administrator, DHA from Allottee / Transferee requesting Registration of Sub Lease 'A' with full address and telephone No.
b.
National Identity Card (Two photocopies) of owner and two photocopies of each witness (Photocopies of NIC of owner and witness should be on one page).
c.
A fresh No Demand Certificate from Account Branch DHA (Original).
d.
Allotment Order / Transfer Order / Division Order (Two photocopy). Duly stamped from Board of Revenue Sindh if applicable.
e.
Site Plan issued within last two years; one copy on Ammonia Print.
f.
Sub Lease 'A' document duly affixed Special Adhesive Stamps from Central Stamping Office, City Court Karachi (value of stamp may be got checked from Sub Registrar Clifton Town-1 before affixing).
g.
One latest Passport Size Photograph for pasting on Lease documents.(do not paste photograph)
h.
Receipt of Construction Bye Laws (One photocopy).
IN CASE OF SPECIAL POWER OF ATTORNEY
Original Special Power of Attorney duly registered / attested by PAKISTAN EMBASSY if outside Pakistan, along-with on photocopy having Rs. 2/- Court Fee Stamp on it.
IN CASE OF GENERAL POWER OF ATTORNEY
a.
Two photocopies of General Power of Attorney (GPA) duly Registered by a Sub-Registrar / Distt. Registrar or attested by PAKISTAN EMBASSY if outside Pakistan, having Rs. 2/- Court Fee Stamp on it.
b.
Photo copy of acceptance letter of GPA issued by DHA.
c.
Certificate to the effect that the execution of the power is alive duly attested by Oath Commissioner / Notary Public / Class - I Gazetted Officer.
NOTES
a. Registration of normal documents is carried out TUESDAY & THURSDAY between 1100 Hours To 1300 Hours.
b. At the time of Registration you must be in possession of your Original National Identity Card for Identification.
c. You are required to bring Pay order amount of Rs.150/- in the name of Sub-Registrar-I Clifton Town, Karachi being Registration fee of the document.
'B' / 'C' LEASE
These are 99 years Leases executed between the MEO, on behalf of the president of Pakistan, the Authority and the allottees/transferees who, so ever obtain these Leases will have the Lease hold rights of the plot with construction thereon for about 99 years, renewable after the expiry of the said period. Lease 'B' is executed in respect of residential plots and Lease 'C' in respect of commercial plots only on completion of the building.
DOCUMENTS REQUIRED FOR 'B' / 'C' LEASE
The under-mentioned formalities are required for these Leases.
a.
Covering letter addressed to the Administrator, DHA from Allottee / Transferee requesting Registration of 'B' / 'C' Lease.
b.
National Identity Card (03 Photocopies of applicant and witness should be on one page in same side).
c.
A fresh 'NO DEMAND CERTIFICATE' from Account Branch, DHA (Original).
d.
A fresh 'NO DEMAND CERTIFICATE' C.B.C (House Tax Conservancy Tax and water charges etc. (Original and one photocopy).
e.
Allotment / Transfer Order (Two Photocopies). Duly stamped from Board of Revenue Sindh if applicable.
f.
Sub-Lease 'A' / License (Two Photocopy).
g.
Form 'B' / 'C' Lease three copies. Special Adhesive Stamp (from Central Stamping Office, City Court Karachi) affixed on one copy along-with Photocopy of CHALLAN for Adhesive Stamp and thereafter signatures on all three copies. (Value of stamp may be got checked from Sub Registrar Clifton Town-1 before affixing)
h.
One latest Passport size photograph for pasting on lease documents.(do not paste photograph)
i.
Site Plan issued within last two years; three copies on Ammonia Print (Signed by the owner)
j.
Approved Building Plan along-with Approval letter (Photocopy)
k.
Building Completion Certificate along-with Completion Plan from C.B.C (Two Photostat copies).
l.
Is there any LOAN / MORTGAGE / Lien or any other encumbrance on the property (Get removal of lien mark letter from DHA Transfer & Record Dte).
m.
N.O.C. obtained from BANK / H.B.F.C. (Original and One Photocopy).
n.
Has the area of the plot ever been increased / decreased if increase have you paid all dues including cost as determined by the Authority for the increased area.
NOTES
a.
Provided there is no observation, Lease documents duly signed by the authorized Officers / Officials of DHA will be taken by the applicants OR their authorized representatives for execution / signatures by MEO, Karachi. They will then deliver it back to DHA Lease Section for registration before Sub-Registrar.
b.
After the execution of 'B' / 'C' Lease by MEO, Karachi, the documents will be ready for registration within 120 days. After expiry of this period the owner can get the documents registered within another 120 days with penalty imposed by Sub Registrar. If it is not registered within the prescribed time it will become time barred and a fresh case will have to be initiated.
c.
Site visit of the property will be conducted by DHA Planning Directorate Field Staff within one week, without which the case will not be processed.
d.
You are required to bring Pay order amount of Rs.200/- in the name of Sub-Registrar-I Clifton Town, Karachi being Registration fee of the document.
'B' LEASE - DARAKHSHAN VILLA / SEAVIEW APARTMENT
Seaview Apartments and Darakhshan Villas have been constructed by DHA. The allottees/transferees of these Apartment/Villas are required to get 99 years 'B' Lease to be executed between the MEO, on behalf of the President of Pakistan.
DOCUMENTS REQUIRED FOR 'B' EASE
The under-mentioned formalities are required to be completed before execution of the 'B' Lease - Darakhshan Villa / Seaview Apartment.
a.
Covering letter addressed to the Administrator, DHA from Allottee / Transferee requesting Registration of 'B' Lease - Darakhshan Villa / Seaview Apartment.
b.
National Identity Card (03 Photocopies of applicant and witness should be on one page in same side).
c.
A fresh 'NO DEMAND CERTIFICATE' from A/C Branch, DHA (Original).
d.
A fresh 'NO DEMAND CERTIFICATE' C.B.C (House Tax Conservancy Tax and water charges etc.(Original and one photocopy).
e.
Allotment / Transfer Order(Two photocopies). Duly stamped from Board of Revenue Sindh.
f.
One latest Passport size photograph for pasting on lease documents.(do not paste photograph).
g.
Form 'B' Lease three copies. In case Garage is allotted then Amending Deed shall be executed separately.

RECTIFICATION / AMENDING DEED
Many a times, after execution of the Lease, necessity for rectifying/amending the said Lease arises when there is an increase/decrease in the area of the plot, or in its boundaries, or any defect, noticed after registration of the Lease.
DOCUMENTS REQUIRED FOR RECTIFICATION / AMENDING DEED
Following formalities are required to be completed for rectification deed.
a.
Application addressed to the Administrator, DHA from Allottee / Transferee requesting Registration of rectification / amending deed with full address and telephone No.
b.
Dues clearance endorsement on application from Account Branch.
c.
National Identity Card (Two Photocopies) of owner and two photocopies of each witness (Photocopies of both sides of NIC of owner and witness should be on one page).
d.
One latest passport size photograph (do not paste photograph).
e.
Photocopy of ‘A’ Lease (in case of KMC land photocopies of ‘B’/’C’ Lease).
f.
Rectification / Amending Deed document duly affixed with Special Adhesive Stamps from Central Stamping Office, City Court Karachi (value of stamp may be got checked from Sub Registrar Clifton Town-1 before affixing).
g.
Site Plan; One copy on Ammonia Print.

SURRENDER DEED
The Surrender Deed is executed whenever a plot whose Lease has already been registered by the allottee/ transferee, subsequently desires to sub-divide the plot, or to gift away the plot in favour of his/her legal/natural heirs or to transfer the plot to any person registered with the Authority, in such cases the original Lease already registered will have to be surrendered before execution of a fresh Lease in the name of transferees.
DOCUMENTS REQUIRED FOR SURRENDER DEED
For the purpose of Registration of Surrender Deed, the following formalities are required to be completed: -
a. Application addressed to the Administrator, DHA from Allottee / Transferee requesting Registration of Surrender deed with fully elaborating the purpose of Surrender.
b. National Identity Card (Two Photocopies) of owner and two photocopies of each witness (Photocopies of both sides of NIC of owner and witness should be on one page).
c. No Demand Certificate from Account Branch for Surrender deed (Original)
d. Certificate to the effect that the plot is open (Specimen attached).
e. Sub Lease ‘A’ Original along-with one Photocopy.
f. Two identical Affidavits for surrender on Rs. 20/- non-judicial Stamp Paper duly attested by Oath Commissioner (Specimen attached).
g. Surrender deed Form duly affixed Special Adhesive Stamp from Central stamping office, City Court Karachi.
h. One latest Passport size photograph (do not paste photograph).
i. In case NOC for loan obtained from DHA, NOC / Redemption Deed from Bank/HBFC (Original).
